The Brazilian Government enacted, on August 24, 2026, the Mercosur Electronic Commerce Agreement (Mercosur Agreement), originally signed five years ago by the stipulating parties, which are part of this e-commerce “block”. The Mercosur Agreement is signed and applicable in the same manner for residents of Brazil, Argentina, Paraguay, and Uruguay.
The Decree No. 13,104 enacts the Mercosur Agreement, and makes it part of the Brazilian legal framework. The enactment of this Agreement is primarily focused on the development of cross-border electronic commerce between the signing parties, but also on the development of cross-border e-commerce beyond that, from the perspective of Brazil’s e-commerce.
Mercosur Agreement’s Scope
Electronic transactions between the signing parties are going to be governed from now on by a common set of provisions with a principal focus on the reduction of barriers in cross-border electronic commerce. With the enactment of the Mercosur Agreement, the Brazilian Government introduced a set of measures that blocks imposing of any sort of customs duties on online transactions carried out between the signing parties.
The decree by which the Mercosur Agreement became enforceable also introduces the recognition of the legal validity of e-signatures used in member countries.
Easier and less-fragmented exchange of the consumer’s data through e-channels is also one of the most noticeable parts of this Agreement. Bloc countries should allow easier access to customers’ information(when it comes to online shopping experiences) while maintaining a high level of data protection/
The Mercosur Agreement lays down the legal framework for the following sections, which are going to be regulated in more detail with the upcoming legislation:
- Cooperation in cybersecurity
- E-government
- Digital commerce for micro, small, and medium-sized enterprises.
The rules will be reviewed every two years to keep pace with technological changes and new international discussions.
